RECENT UPDATES ON TEMPORARY FOREIGN WORKER PROGRAM PROCEDURES FOR OWNER-OPERATOR LMIA

Attention to all aspiring immigrants via the Owner/Operator LMIA stream. Canada immigration policies will be updated starting April 01, 2021, on the special Temporary Foreign Worker Program (TFWP). Owner/Operator candidates’ assessment will be in the same manner as other TFWP applicants. In the current procedures, candidates in this category are exempted from advertising and recruitment requirements in obtaining an affirmative Labor Market Impact Assessment.

The Employment and Social Development Canada (ESDC) says, “As part of regular policy reviews to ensure the TFWP continues to work within its intended purpose and is only used by employers to fill a position when qualified Canadians or permanent residents are not available.” This shift reflects the recent updates on Temporary Foreign Worker Program procedures for Owner-Operator LMIA, emphasizing the program’s alignment with broader goals to prioritize the Canadian labor market’s needs.

Applicants of the Owner-Operator program are the ones who qualify for a work permit by purchasing a business and moving to Canada. They are the major shareholder and have full control over their intended business, marking a significant pathway for entrepreneurs and business owners to enter Canada. This change underscores the importance of staying informed on immigration policies and procedures, ensuring that prospective immigrants and business owners fully understand the requirements and adjustments in the owner-operator LMIA and temporary foreign worker program.
